Man who raped woman in home jailed for extra five years


A convicted paedophile who raped a young mother and assaulted her toddler will spend more time in prison after the Court of Appeal decided his original sentence at Exeter Crown Court was unduly lenient.
Ross Wyborn, now 25, broke into the victim’s home while she was having a bath and while her two-year-old daughter was asleep in her room.
The victim heard noises and got out of the bath, covering herself with a towel in order to investigate. Wyborn dragged the victim to the floor and made her perform a sexual act, and he then raped her.
The victim’s daughter woke up while the offending was happening and Wyborn forcefully shoved the child back into her room.
Wyborn was originally sentenced to 10 years’ imprisonment with a licence extension of 5 years in February at Exeter Crown Court.
He was described as ‘every woman’s worst nightmare’
However, the Court of Appeal has now increased his sentence to 15 years with a licence extension of 5 years.
Exeter Crown Court was told in February that Wyborn had been out of prison for less than six weeks when he broke into the house in Ilfracombe through an insecure door and started searching it.
The noise of the assault woke her daughter who came out of her bedroom to see her mother being attacked.
Wyborn broke off the rape and threw the little girl back into her room before slamming the door and carrying on with the rape.
He was already a registered sex offender with two convictions for sexual activity with a 13-year-old girl
He had been released from jail 39 days before he committed the rape in May last year.
He is also a prolific burglar with nine previous convictions.
He had spent the intervening time partying and taking drugs while sofa surfing with friends. He was high on cannabis and cocaine when he attacked the victim on May 21 last year.
He was trapped by DNA but tried to lie his way out of trouble by blackening the victim’s name.
The jury at his trial were played a recording of her 999 call to the police which showed she was terrified, sobbing and hysterical and had no idea of the identity of her attacker.
Wyborn, aged 25, of Fore Street, Ilfracombe, denied but was found guilty of two counts of rape, assault by penetration, and assault by battery of the child.
Judge Timothy Rose put him on the sex offenders register for life and made a Sexual Harm Prevention Order preventing him from going into any lone female’s home in the future.
He told him: “This was a truly terrifying experience for the victim. It is quite literally any woman’s worst nightmare, any person’s worst nightmare, to be alone at home and find a stranger outside the bathroom when they are in the bath.
“Instead of reacting by leaving, you attacked her physically, forced her to the floor and raped her twice.
“You lied in every conceivable way. You changed your story repeatedly and accused her of receiving money for sex. You said she was in a consensual relationship with you, which was absolute nonsense. You traduced her reputation to try to make out a defence.
“You made an uninvited entry into her home in a situation when she was particularly vulnerable and could not escape because of her responsibilities to her child. I have no doubt you must be dealt with as a dangerous offender.”

Man jailed for sex with girl

A convicted sex offender has been jailed for two years and four months for having sex with a underage schoolgirl
Ross Wyborn, from Barnstaple, was 21 at the time of the offence, Exeter Crown Court was told. He gave the girl gifts and sent her love letters before having sex with her.
The defendant, previously of Forches Avenue, admitted two counts of sexual activity with a child.
Prosecutor Mr David Sapiecha said the defendant had a previous conviction for sexual activity with a 13-year-old girl
He is currently serving a prison sentence for burglary and being held in HMP Channings Wood in Newton Abbot.
The defendant was told to sign the Sex Offender Register and made the subject of a Sexual Harm Prevention Order restricting his contact with girls.
